PanTerra Networks ("Company") is committed to protecting your privacy. To better protect your privacy, we provide this privacy policy ("Privacy Policy") explaining our information practices and the choices you can make about the way your information is collected and used. This Privacy Policy covers all PanTerra Networks official websites, portals, services and mobile applications ("PanTerra Services") and applies to all Customers (including Customer's End Users) and other users that use the Company's Services, products, APIs or website.

THE INFORMATION WE COLLECT
When you visit, access or use the PanTerra Services, we may collect personally identifiable information, including but not limited to name, address, phone number and email address which are voluntarily supplied to us through on-line forms.

We also may collect certain non-personally identifiable information when you access PanTerra Services, such as the type of browser you are using (e.g., Netscape, Internet Explorer), the type of operating system you are using, (e.g., Windows XP or Mac OSX) and the domain name of your Internet service provider (e.g., AT&T, Verizon or Earthlink).

We use common Internet technologies, such as cookies, to keep track of interactions with our websites and cloud services. Cookies are text files that are placed in your computer’s storage system (hard drive) to store things such as your preferences or registration information. We do not use cookies to store any personally identifiable information about you. We use cookies to understand PanTerra Services usage and to improve our services. For example, we may use cookies to personalize your experience with PanTerra Services (e.g., to recognize you by name when you return to PanTerra Services). We also may use cookies to offer you products or services or send you newsletter that you may voluntarily accept. Any recurring newsletter will have the option for you to opt-out of the subscription.

We also may collects certain information about your computer or mobile device for security and identification purposes. This information may include: IP addresses, MAC address, domain names, access times, cookies and other unique identifying information of devices that access our services or have PanTerra software downloaded and installed on them. This information is used for the operation of our service, to identify and protect our users and to control unauthorized use or abuse of our services. All information is encrypted during transmission and is stored securely within our infrastructure.

User information may be collected during a communications session such as a Streams messaging session, Connect video conferencing or screen sharing/desk sharing session ("In-Session Information" or "ISI"). Such ISI is protected by the use of end-to-end encryption and only accessible by the authorized users, organizers and participants. ISI includes (but is not limited to) all screen or desk sharing data, keyboard/mouse control data, text messaging information, voicemail or transcribed voicemail text, faxes, emails and audio/video calls. This information is kept private while temporarily resident within our cloud infrastructure or during transmission across public or private networks. Account administrators and/or users have control as to who sees or has access to their information.

Because of our commitment to deliver the best possible service to our users, we track certain anonymous information such as the category of services selected by our users as well as all voluntary provided information pertaining to user satisfaction. To ensure the quality of our product, we reserve the right to maintain evaluation and feedback records.

PanTerra Services are not directed to individuals under 13. We do not knowingly collect personal information from children under 13. If you become aware that a child has provided us with personal information, please contact us at support@panterranetworks.com . If we become aware that a child under 13 has provided us with personal information, we will take steps to delete such information.

HOW WE USE THE INFORMATION
We use the information you provide about yourself to respond to your inquiries about our products and services, to send you news and updates about our offerings to provide you with opportunities to purchase other products or services that we believe may be of interest to you. We will keep any personal information strictly confidential and within our Company except as noted below. We will not sell, trade or give out any personal information to third parties except as noted below.

We will disclose personally identifiable information in response to legal process or when we believe in good faith that the law requires it.

Our products and services may by necessity require us to provide some of your information to third parties. We may employ other third parties to perform functions on our behalf such as processing credit card payments, sending postal mail and email, analyzing data and providing sales, marketing and/or support assistance. They may have access to personal information needed only to perform their functions and may not use it for any other purpose. Further, they must process the personal information in accordance with this Privacy Policy.

If you wish to stop receiving any offers or contact from PanTerra Networks, simply contact us (you can reply to an email or click the opt-out link) and request that you be removed from our database.

PanTerra Networks does not control the practices of our affiliates or partners. If you have questions about how affiliates or partners use the information gathered when you link to them, please read their privacy policies.

Links to other sites: PanTerra Services may contain links to non-PanTerra Networks sites that are not owned or controlled by us. Please be aware that PanTerra Networks is not responsible for the privacy practices of such other sites.

PanTerra Networks is not liable for loss of passwords due to user carelessness. If you lose control over your password, you may lose control over your user content, personally identifiable information and/or PanTerra Networks' services. If you believe your password has been compromised, we strongly recommend that you immediately change your password.

SHARING AND DISCLOSURE OF INFORMATION TO THIRD PARTIES
We may share and disclose your information we collect with third party affiliates, business partners, contractors, vendors or authorized agents to:

Perform data processing for the Services;
Operate, deliver, improve and customize our Services
Provide support and technical services;
Send marketing and other communications related to business;
Enforce our acceptable use policy;
Law enforcement agencies, regulatory or governmental bodies, or other third parties in order to respond to legal process, comply with any legal obligation; protect or defend our rights, interests or property or that of third parties; prevent or investigate wrongdoing in connection with our websites, APIs, apps or our Services;
Any third parties in connection with prospective or actual, sale, merger, acquisition, financing or reorganization of our business
YOUR PRIVACY RIGHTS
Update and Access to Your Information
Where we process personal information collected via our Website or Apps or via our Services for our own account management, billing or marketing purposes and where required by applicable law, we provide individuals with the opportunity to access, review, modify, and delete any such personal information that we process.

Your Privacy Rights as an EEA Person
In addition, if you are from the EEA, you may have broader rights to access and delete your personal information, to object to or restrict processing of your personal information, or request portability of your personal information.

If we have collected and processed your personal information with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent.

You also have the right to complain to your local data protection authority at any time.

In general, when processing personal information to provide our Services, we do so only on behalf of our EEA Customers and in accordance with their instructions. This means that if you wish to access, review, modify or delete any personal information we process on behalf of Company's Customer, under applicable EEA law or otherwise, you should contact that Customer with your request. We will then help them to fulfill that request in accordance with their instructions.

Your Privacy Rights as a California Resident
If you are a California resident and use Company's Services or visit our Website or Apps solely as a private individual—in other words, not as the member or representative of a company or other organization—you may have the right to receive a free, yearly accounting of:

information identifying each third party company to whom we may have disclosed, within the past year, personal information pertaining to you for our direct marketing purposes; and
a description of the categories of personal information disclosed.

SECURITY
Keeping your information secure is important to us. The Company maintains a variety of appropriate technical and organizational safeguards to protect your personal information both during transmission and once it is received. The Company has no control over or responsibility for the security or privacy policies or practices of other sites on the Internet you might visit, interact with, or from which you might buy products or services, even if you visit them using links from our websites.

Please note that no website, mobile app or service is completely secure and so, while we endeavor to protect our Customers' information using the measures described above, we cannot guarantee that unauthorized access, hacking, data loss or a data breach will not occur.

HIPAA Compliance
If a customer is a Covered Entity or a Business Associate as defined under the Health Insurance Portability and Accountability Act (HIPAA) and it will use Company's services to create, receive, transmit, or maintain PHI, the customer must have in place a Business Associate Agreement (BAA) with the Company. Company will act as a Business Associate, and it will manage its HIPAA obligations accordingly.

The Company's BAA further outlines the respective HIPAA obligations of both the Company and customer. For more information on requesting a BAA, please contact a Company representative to review the Company's Business Associate Agreement (BAA).

Please note that the customer is ultimately responsible for determining their organization’s overall compliance with HIPAA.

DATA RETENTION
We will retain your personal information for no longer than is necessary to fulfill the purposes for which the information was originally collected unless a longer retention period is required or permitted by law, for legal, tax or regulatory reasons, or other legitimate and lawful business purposes.

Where we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it.

INTERNATIONAL DATA TRANSFERS
Your personal information may be transferred to, and processed in, countries other than the country in which you are resident. Specifically, information collected outside the United States, including in the European Economic Area ("EEA"), may be transferred to and stored on our servers in the United States and potentially in other countries where we or our partners operate. These countries may have data protection laws that are different to the laws in your country (and in some cases, may not be as protective).

CHILDREN'S PRIVACY
The Company does not provide products or services that are designed for use by children under the age of 16, or knowingly collect personal information from or about children under the age of 16.
